Professional Terms for Educators • India Law Compliant

Teacher Agreement & Commission Policy

Effective: September 2026 • Sachan Tutorials Educator Partnership & Data Governance Terms

Statutory Legal Advisory: This Agreement constitutes a legally binding contract under the Indian Contract Act, 1872 and the Information Technology Act, 2000. All educators are strongly advised to review these terms with independent legal counsel before accepting tuition matches or registering with Sachan Tutorials.
The Transparent 50% First-Month Commission Model:

• Month 1 (Advance Collection & Matching Commission): Tuition fees are collected 100% in advance from parents directly by Sachan Tutorials prior to commencement. Following the 1–2 day trial demo confirmation, the bureau retains 50% of the first month's finalized tuition fee as its one-time placement and verification charge, and disburses the educator's earned share directly.

• Month 2 and Beyond (100% Retained by Educator): For all subsequent months (Month 2, 3, 4, 12, etc.),100% of the tuition fee is collected and retained directly by the educator. The bureau charges zero monthly cuts, zero renewal charges, and zero recurring royalties.

1. Masked Lead Sharing & Disclosure System

To protect student privacy and ensure fair allocation, all student tuition inquiries are displayed to registered educators in masked form only. Visible parameters prior to unlock include: unique lead code, grade/class, required subjects, broad locality/city (e.g. Kakadeo, Kanpur), preferred learning mode, and timing.

Personally identifiable information—including student full name, guardian name, contact telephone, WhatsApp number, exact residential address, and specific school—is completely withheld. Contact details are disclosed strictly upon:

  • The educator submitting an explicit Expression of Interest via the Teacher Portal.
  • Sachan Tutorials administrators reviewing teacher credentials and manually approving the match (limited to a maximum of 3 matched educators per student lead).

2. Confidentiality & Purpose Limitation (DPDP Act 2023)

Upon unlocking student details, the educator becomes a legal Data Processor under the Digital Personal Data Protection (DPDP) Act, 2023 and agrees to the following statutory covenants:

  • Purpose Limitation: Contact numbers and addresses must be utilized exclusively for contacting the guardian to schedule the trial demo class and deliver authorized academic tutoring.
  • Strict Non-Disclosure: Educators shall not share, screenshot, distribute, or resell student or guardian personal information to any third party, coaching institute, or marketing firm.
  • Data Retention & Deletion: If a demo class does not result in confirmed tuition, or upon cessation of tutoring services, the educator is legally obligated to permanently delete student phone numbers and address records from their personal devices.

3. Non-Circumvention & No-Bypass Obligation

Educators acknowledge that student leads introduced through Sachan Tutorials represent proprietary business assets of the bureau. Educators expressly agree:

  • Not to circumvent, bypass, or privately contract with parents/students introduced by Sachan Tutorials with the intent of avoiding the agreed 50% first-month commission.
  • Not to accept private tutoring engagements for siblings, relatives, or neighbors referred directly through an introduced family without prior written notice and registration with Sachan Tutorials.
  • Any unauthorized private arrangement or deliberate bypass constitutes a material breach of contract, resulting in immediate permanent account blacklisting, forfeiture of pending dues, and initiation of civil recovery proceedings in Kanpur jurisdiction.

4. Independent Contractor Status

Educators registered with Sachan Tutorials act strictly as independent freelance professional tutors and not as employees, partners, or agents of Sachan Tutorials. Tutors maintain full autonomy over their academic methodology, subject curriculum delivery, and agreed timetable slots, while complying with the professional code of conduct.

5. Mandatory Document Audits & Verification

All educators must submit valid government-issued photo identity proof (Aadhaar/PAN/Voter ID) and educational degree certificates. The "Verified Teacher" designation is awarded solely after manual administrative review. Falsification of academic records or identity documents will result in immediate termination, blacklisting, and reporting under the Bharatiya Nyaya Sanhita (BNS).

6. Trial Demo Session & Client Evaluation Window (1–2 Days)

For every newly matched tuition, the educator agrees to deliver an initial trial demo session (spanning 1 to 2 days) at the student's residence or online. Clients have a strict 24 to 48 hour (maximum 2 days) evaluation window to verify compatibility or request a tutor replacement. In the absence of a replacement request within this window, the tuition is deemed finalized.

7. Governing Law & Jurisdiction

This Agreement is governed by the laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts in Kanpur, Uttar Pradesh.
